General Policies - By using our services you agree that you have read, understood and will comply with the following terms of use.  You agree that you are over the age of 18 and may lawfully enter into contracts under applicable law.  Any user of our site agrees to abide by any rules, laws or statutes which govern this site as well as any US federal or state laws.  Any user who is found to disobey these terms will be removed from participation on this site.  Terms may be modified at times.  Users will be notified of any changes and given the opportunity to agree or voluntarily leave the site.

Bidding and Buying - Users who bid on an item have agreed to a legal, binding contract to complete the purchase.  Winning bidders who do not pay will be blocked from participating in future auctions or sales.  Bidders are required to provide proof of ID as well as a current credit card for payment.  All lots are subject to extended bidding time if bids are received within the last 5 minutes of the timed auction.  Bid retractions may be permitted under special circumstances.  Jarman Auction Company reserves the right to refuse any bid or remove any bidder from participation at our discretion.  Should there be any malfunctions of the electronic bidding system caused either by natural or man-made occurrence, Jarman Auction Company reserves the right to continue the auction with extended time, close the auction or re-list any items that may have been affected by the outage.  We also reserve the right to retract winning bids that occurred during the outage and re-offer those lots affected.  In these cases, bidders and sellers will be notified of actions.  Buyer's premium will be applied to all lots sold, to be paid by the purchaser as part of the purchase price, which is then applicable to all local taxes, shipping and delivery fees (if applicable).  All items sold on Jarman Auction Company are expected to show some signs of age or use.  Other than specific guarantees for accuracy or condition, all items are sold "AS IS" and the consignor nor Jarman Auction Company guarantees or warranties any items sold.

Selling - Sellers may have a minimum bid or reserve listed for each item.  Sellers are not obligated to sell unless the minimum or reserve price has been met.  Sellers will be charged for items not sold (see Seller fees).  Sellers are not permitted to bid on their own lots.  Sellers must abide by all rules governing what items are permissible to sale relating both to our rules and all US federal and state laws.  Jarman Auction Company reserves the right to remove any item or seller from this site based on our discretion.  Sellers agree that they have the right to sell their items and that there are no debts or encumbrances on any items presented for sale and that clear and good title will pass to the buyer without any claims.  Sellers guarantee that items are presented with accuracy and complete condition descriptions.

Payment Policy - All Payments must be made within 48 hrs of auction closing.  We will charge your card on file for hammer price, buyer's premium and sales tax (unless you have a for ST-4 or ST-5 on file with Jarman Auction Company).  By bidding in our auctions you agree to authorize payment with your card on file of up to $5000.  Totals over $5000 require bank check, cash or wire transfer.  Contact us for wire transfer information.  

Shipping Policy - We offer shipping on many items.  Those items will have estimated weights or other shipping details and options added to their description.  In general, items weighing under 10 lbs will be shipped by US mail.  Most items over 10 lbs will be shipped by UPS Ground.  Minimum shipping for any First Class package is $5.95.  Handling fees based on weight and package difficulty will be added.  Items over $500 in value may require outsourced professional packing to comply with insurance requirements.  Insurance will be added to all packages.  Delivery is available for most items purchased if you are within 50 miles of zip code 31322.  Contact us for delivery charge. Large items going outside of the area may be shipped via freight or other courier services.  We will work with your freight company but all payment arrangements must be made to them.  If your item(s) must be palletized, there will be a $75 pallet fee to cover all costs.  All shipping, handling and/or delivery charges must be paid by the purchaser.

 Pick up Policy - All items must be picked up or arranged to be shipped within 7 days of sale closing.  Any items remaining over 7 days will be forfeited with no refunds given.  If additional time for pickup is required, buyer must contact us within 7 days to extend pick up time.  Extended time will be charged $50 for each pallet sized item(s) per week.  After 4 weeks, the item(s) will be treated as abandoned.  No refunds of any kind will be given in this case.
